Returns, Refunds & Warranty Policy
MJ MOTOR AUSTRALIA PTY LTD
At MJ MOTOR, we aim to provide quality products and reliable customer service. If you have a problem with your purchase, please contact us as soon as possible so we can assess the issue and provide an appropriate solution.
This policy applies in addition to your rights under the Australian Consumer Law (ACL). Nothing in this policy excludes, restricts or modifies any consumer guarantee or other right that cannot legally be excluded, restricted or modified.
1. Australian Consumer Law
All products sold by MJ MOTOR are covered by the consumer guarantees under the Australian Consumer Law where applicable.
If a product does not meet a consumer guarantee, we will provide an appropriate remedy in accordance with the law.
Depending on the nature and seriousness of the problem, the remedy may include:
- Repair
- Replacement
- Refund
- Partial refund or other appropriate compensation
For a major problem, you may be entitled to choose between a refund and a replacement.
For a minor problem, MJ MOTOR may first arrange a repair or replacement where appropriate.
We reserve the right to inspect and assess the product before determining the appropriate remedy, where permitted by law.
2. Dead on Arrival (DOA)
A product is considered Dead on Arrival when it has a major fault or cannot function as intended when first received, and the problem was not caused by assembly, misuse, incorrect installation, accident or other customer-related circumstances.
DOA claims
Please contact us as soon as possible after receiving your product, preferably within 14 days of delivery, if you believe the product is Dead on Arrival.
To help us assess the claim, please provide:
- Your order number or proof of purchase
- Photos and/or videos showing the problem
- A description of the issue
- Photos of the product and packaging where relevant
We may request additional information or arrange an inspection.
If the product is confirmed to have a major problem, MJ MOTOR will provide the remedy required under the Australian Consumer Law.
For products with a minor fault, we may arrange a repair or replacement where appropriate.
Important
Starting, assembling or using a product does not automatically remove your rights under the Australian Consumer Law.
However, damage caused by incorrect assembly, misuse, modification, accident, neglect or use outside the intended purpose may not be covered as a manufacturing fault.
3. Faulty Products
If a product develops a fault after it has been used, please contact us before attempting major repairs or modifications.
We may ask you to:
- Provide photos or videos of the fault
- Perform basic troubleshooting
- Bring the product to our premises for inspection
- Return a component or part for testing
- Arrange inspection by an appropriate technician
Where the issue is covered by the Australian Consumer Law or the applicable warranty, MJ MOTOR will provide the appropriate remedy.
Depending on the problem, this may include:
- Replacement parts
- Repair
- Replacement of the product
- Refund, where required by law
Warranty
Some products also include a separate manufacturer's or MJ MOTOR warranty.
The applicable warranty period and conditions will be stated on the relevant product listing, invoice or warranty documentation.
A warranty does not replace or limit your rights under the Australian Consumer Law.
4. Change of Mind Returns
If you simply change your mind, order the wrong product, decide that you no longer want the product, or find the product cheaper elsewhere, you are generally not entitled to a refund under the Australian Consumer Law.
However, MJ MOTOR may, at its discretion, agree to accept a change-of-mind return.
If we agree to accept the return:
- The return must be approved by MJ MOTOR before the product is sent back.
- The customer is responsible for the return freight/shipping cost.
- Original outbound freight costs are generally non-refundable.
- A reasonable restocking fee may apply where permitted and agreed in advance.
- The product must be returned in unused and resalable condition.
- The product must include all original accessories, parts, manuals and packaging where applicable.
- Products that have been assembled, fuelled, ridden, modified or used may not be accepted as change-of-mind returns.
Please do not return a product without obtaining approval from MJ MOTOR first.
Any change-of-mind return is separate from, and does not affect, your rights under the Australian Consumer Law.
5. Wrong Item Received
If you receive an item that is different from what you ordered, please contact us as soon as possible.
Please provide:
- Your order number
- Photos of the item received
- Photos of the packaging and shipping label
- A description of the issue
Please do not use or modify the item until we have assessed the situation.
If MJ MOTOR has supplied the wrong product, we will work with you to arrange an appropriate solution, which may include replacement, return and/or refund as applicable.
6. Damaged in Transit
If your product appears to have been damaged during transportation, please contact us as soon as possible.
For freight deliveries, please:
- Take photos of the carton before opening it where possible.
- Take photos of any visible damage to the packaging.
- Take photos of the product and damaged components.
- Keep the original packaging until the matter has been resolved.
Please contact us before arranging repairs or disposing of damaged packaging.
We will assess the circumstances and work with the freight carrier and customer to resolve the issue.
7. Products That Have Been Assembled or Used
Many of our products are supplied in cartons and require assembly.
Customers should carefully inspect the product and read the assembly and operating instructions before use.
Where a problem is caused by:
- Incorrect assembly
- Incorrect adjustment
- Misuse
- Accident
- Neglect
- Unauthorised modification
- Use outside the intended purpose
- Failure to follow operating instructions
- Normal wear and tear
the issue may not be covered by a manufacturer's warranty.
This does not affect any rights the customer may have under the Australian Consumer Law.
8. Parts and Warranty Claims
For parts supplied under warranty, MJ MOTOR may require the faulty part to be returned for inspection before a replacement is provided.
Depending on the circumstances, we may provide:
- A replacement part
- Troubleshooting assistance
- Repair instructions
- A replacement component
- Other appropriate assistance
Unless otherwise required under the Australian Consumer Law, labour costs, installation costs, removal costs and freight costs associated with warranty repairs are not automatically covered by a manufacturer's warranty.
Any specific warranty terms stated on the relevant product listing will also apply.
9. Return Approval
Before returning any product, part or component, please contact MJ MOTOR and obtain return instructions.
Please include:
- Order number
- Customer name
- Contact details
- Product/model
- Description of the problem
- Photos or videos where relevant
Unauthorised returns may experience delays in processing.
Do not send products to MJ MOTOR without first contacting us.
10. Order Cancellation
If you wish to cancel an order, please contact us as soon as possible.
Before dispatch
If the order has not yet been dispatched, we will try to accommodate your cancellation request.
Any applicable cancellation fee or deduction will be advised before the cancellation is processed.
After dispatch
If the order has already been dispatched, cancellation may not be possible.
The customer may need to receive and return the product in accordance with our applicable return policy.
This does not affect any cancellation or refund rights provided by the Australian Consumer Law.
11. Freight and Return Costs
For products that are confirmed to have a problem covered by the Australian Consumer Law, MJ MOTOR will meet applicable reasonable return or transport costs as required by law.
For change-of-mind returns, the customer is generally responsible for return freight and any agreed applicable costs.
For large or heavy products such as:
- Go-Karts
- Buggies
- ATVs
- Dirt Bikes
- Mini Jeeps
- UTVs
special freight arrangements may be required.
Please contact us before arranging the return of any large or heavy item.
12. Refund Processing
Where a refund is approved, the refund will generally be processed using the original payment method unless otherwise agreed or required by law.
Refund processing times may depend on the payment provider or financial institution.
Any refund will be processed in accordance with the applicable Australian Consumer Law requirements.
13. Exclusions and Limitations
Nothing in this policy is intended to exclude or limit rights that cannot legally be excluded under the Australian Consumer Law.
This policy does not remove a customer's rights where a product:
- Has a major failure
- Has a minor failure requiring a remedy
- Is unsafe
- Is significantly different from its description
- Is not fit for a disclosed purpose
- Does not meet another applicable consumer guarantee
